The Fight for DACA Continues

Deferred Action for Childhood Arrivals (DACA) recipients, their families, and their communities remain in limbo after the U.S. District Court for the Southern District of Texas reaffirmed its previous determination against DACA. This decision is another disappointing step back for the valuable immigration program that permits certain immigrants brought to the United States as children to apply, on a case-by-case basis, for temporary work authorization and relief from deportation.

Consistent with previous court decisions related to DACA, the District Court continued to stay the injunction and order vacating DACA rules for current DACA recipients.

The fight for DACA continues as the Biden administration will likely appeal this District Court decision to the Fifth Circuit Court of Appeals, and if necessary, to the U.S. Supreme Court.

So what does this mean for current DACA recipients and eligible DACA youth?

  • Current DACA recipients continue to have status, which includes employment authorization, and can submit DACA renewal applications while litigation on DACA continues

  • Initial DACA applications from DACA hopefuls (i.e. applicants who are applying for DACA for the first time) remain on hold while litigation on DACA continues
