Competitive Bidding and Prevailing Wage Laws

Unions and labor compliance groups have a strong interest in leveling the playing field for contractors who pay fair wages and play by the rules. This is particularly true in the case of federal, state, and local public works construction, generally governed by competitive bidding laws. Reputable businesses are sometimes underbid for these jobs by contractors with a history of wage and hour violations, health and safety problems, and deficient performance.

Although public contracting laws tend to favor low bidders, it is generally the lowest responsible bidders that are eligible to receive contracts for public works construction projects.  Weinberg, Roger & Rosenfeld can assist unions and compliance groups in understanding competitive bidding laws, providing relevant information to public agencies, and avoiding problems.  We also can assist in drafting local ordinances designed to strengthen competitive bidding practices.
